Clark Creative develops, designs, writes, creates and produces “works” (logos, designs, art, copy/text, concepts, ideas, ads, commercials, interactive & packaging products) that, to the extent they are considered original works, are works made for hire under the copyright laws of the United States. Upon full payment of works made for hire, Clark Creative’s policy is to provide any graphic images specifically developed for the client and/or flat files of art and copy/content in agreed upon formats to the client with the exception of those fonts, images and other elements not owned but licensed by Clark Creative for the creation of works.
Unless otherwise specifically requested, agreed upon or outlined in the original scope of work, Clark Creative will not release any files that may reveal proprietary processes for works development, including but not limited to, layered source files. Clark Creative also retains the right to use all works for hire for the purpose of self promotion.
Q: I have not been provided with the font or typeface used in my materials. How may I obtain it?
A: When we use or purchase fonts for use in a project, we haven’t actually purchased the font, but rather a license for use. That license typically limits the use to 1-3 computers and for printing purposes only. The license for use on your personal computer is typically available for all computer OS platforms by purchasing from a registered licensee. Clark Creative will gladly provide information to you about how to obtain a license for your personal computer and office use.
Q: I have been provided the final files of my project; however, I cannot modify the content. Why?
A: There is a degree of equity Clark Creative invests in relationship building with our clients – getting to know them, their preferences, goals, and products/services. We also invest our time in planning for the future and development of a brand and wish to be a part of its growth. Releasing files reduces our chances at this opportunity to orchestrate these plans. In addition, releasing ‘live’ files allows the client to modify materials that may result in a variation of the end product, so the integrity of the brand is at risk. If it is mandatory, Clark Creative will provide these live files for a flat fee of no less than $1,000. A signature is also required on a liability release waiver.
